The long awaited Court of Appeal decision in relation to the income threshold for those wanting to come to the UK to join their spouse/partner has now been published. Unfortunately the Court of Appeal has upheld the original decision to keep the threshold at £18,600 for a single applicant (and £3,400 for the first dependant child and £2,400 for any additional dependant children).
A further appeal is to be pursued but it is anticipated that this will take many months.
In the meantime, 3,600 applications which were put on hold awaiting this decision will now be refused resulting in thousands of family’s being kept apart.
